Report: You might be held responsible if a driver you’re texting causes an accident [w/poll]

There’s no question that driving and texting at the same time is dangerous and illegal. But a lawsuit in New Jersey filed by a couple who were the victims of a texting accident blamed not only the distracted driver who caused it, but also the person who was texting him at the time, CNN reports.

Kyle Best, who was 18 at the time of the accident in 2009, was driving on a rural highway when Shannon Colonna, the 17-year-old girl he was dating, sent him a text. Best allegedly was reading the text when he crossed the double-yellow line and drifted into a lane of opposing traffic. He hit David and Linda Kubert, who were riding a motorcycle. They were injured and lost their legs.

The Kuberts filed suit against Best and Colonna and argued that if she knew that Best was driving when she texted him, she also was responsible for the accident. The Kuberts ended up settling with Best and lost to Colonna, which they appealed. Apparently they left an impression on three appeals court judges who agreed with the principle behind the Kuberts’ appeal, but prosecutors couldn’t prove that Colonna knew Best was driving when she texted him, so she was free to go.

Here’s what the court reportedly said: We hold that the sender of a text message can potentially be liable if an accident is caused by texting, but only if the sender knew or had special reason to know that the recipient would view the text while driving and thus be distracted.

For what it’s worth, this is the state that just rejected a vanity license plate application that read “ATHEIST.”

New Jersey governor Chris Christie disagrees with the appeals court judges who said a text sender like Colonna could be held accountable for a car accident. He says it’s the driver’s responsibility to keep his or her hands on the wheel and pay attention to what’s happening on the road. We have to agree with Christie on this one.

Rally Cross to be held outside on streets of LA for X Games 17

RallyCross and the X Games were made for one another, and X Games 17 will feature one of the coolest tracks ever. The games, which will run from July 28 through July 31, will include a first-ever rally street circuit in downtown Los Angeles.

Three-time rally gold medalist and Top Gear U.S. host Tanner Foust sounds pretty excited about the development, and we can’t blame him. “Being in the car, ripping through streets, cranking the handbrake through intersections while door-to-door and jumping next to buildings is going to be truly epic! I can’t wait!”

We’re guessing ESPN can’t wait either, as the shots from the competition will likely be awe-inspiring. And the sports news network will have the event very well covered, with 25 hours of high definition coverage and another 18 hours of 3D coverage.

And, of course, the X Games wouldn’t be the X Games without dirt bikes, so you can expect plenty of Enduro X coverage. There will also be eight new Moto X competitions, which will take place inside The STAPLES Center. Sounds like a good time. Report: GM, Chrysler sue Allied shippers over cars “held hostage”

A situation has developed between Allied trucking and automakers General Motors and Chrysler that has deteriorated to the point of hostage-taking. The Detroit News reports that GM has filed a lawsuit against the car-hauling company that alleges it’s holding 1,700 of the automaker’s valuable Chevy Silverado and Camaro models that should be on their way to dealers. The vehicles in question are worth $47 million, and many of them are reportedly already bought and paid for by customers. The suit also claims that the inventory will depreciate in value if dealers don’t receive the vehicles, while at the same time dissatisfying customers.

The problems between Allied, GM and Chrysler started when the car hauler asked for a 15-percent raise. Allied had previously tried to cut the pay of Teamster union members by 20 percent, but was unable to do so due to a provision in the company’s labor contract. GM then severed ties with Allied on March 16.

One day after GM filed suit against Allied, Chrysler filed its own lawsuit in Ontario Superior Court. Team Pentastar claims Allied has 700 of its vehicles at Allied locations. The court has already granted Chrysler the right to recover 200 of those vehicles. Chrysler has resourced its vehicle hauling to other car hauling companies as a result of the dispute.

BBC: 1M pedestrians party at banquet held on German Autobahn

The Germans certainly know how to do a block party. According to the BBC, residents between Duisburg and Dortmund have closed 40 miles of the famous Autobahn for one massive street festival. Organizers of the event handed out 20,000 tables in order to help create the longest table in the world as part of the celebration. At some point, the road was even closed to cyclists due to congestion.

Near as we can tell, the whole event was held to celebrate the Ruhr region as part of the area’s nomination as the Cultural Capital of Europe, 2010. Residents came out in droves to participate in everything from singing and dancing to street shows to mark the occasion. We’re guessing there was plenty of good food on hand, too. Sounds like a pretty good time to us, but we have a hard time believing that anyone on this side of The Pond would be okay with shutting down the 405 for a similar summer shindig.
